Terms of Use

These Terms of Use ("Terms") govern access to and use of RepMonitor, a software service operated by Kirill Timofeev PR Mad Lead Printer Novi Sad ("Mad Lead Printer", "RepMonitor", "we", "us", or "our").

By accessing or using RepMonitor, you agree to these Terms. If you do not agree to these Terms, you must not use the service.

1. About RepMonitor

RepMonitor is an email deliverability monitoring platform designed to consolidate data from email sending platforms, deliverability monitoring services, and other connected integrations.

RepMonitor may provide features such as:

• Email sending and delivery performance monitoring
• Bounce and delivery error reporting
• Spam complaint monitoring
• Authentication reporting
• Domain-level deliverability data
• Compliance indicators
• Historical reporting and trend analysis
• Integration with third-party services, including Google Postmaster Tools

The specific features available may change over time.

2. Eligibility and Business Use

RepMonitor is intended primarily for professional and business use.

By using RepMonitor, you represent that:

• You have the legal capacity to enter into these Terms
• You are authorized to use RepMonitor on behalf of your organization, where applicable
• You have all necessary rights and permissions to connect any third-party accounts, domains, systems, or data sources to RepMonitor

You may not connect or access accounts, domains, data, or systems that you are not authorized to manage.

3. User Accounts

Certain RepMonitor features may require a user account.

You are responsible for:

• Providing accurate account information
• Maintaining the confidentiality of your login credentials
• Protecting access to your account
• Ensuring that users accessing RepMonitor through your organization are properly authorized
• Promptly notifying us if you believe your account has been compromised

You are responsible for activity performed through your account unless the activity resulted directly from a security failure attributable to RepMonitor.

4. Connected Third-Party Services

RepMonitor may allow users to connect third-party platforms and services, including email service providers and deliverability monitoring services.

By connecting a third-party service, you authorize RepMonitor to access and process information made available by that service within the scope of the permissions you grant.

You represent that you are authorized to grant RepMonitor such access.

Third-party services are governed by their own terms, policies, APIs, availability, and technical limitations.

RepMonitor does not control third-party services and is not responsible for:

• Changes to third-party APIs
• Changes to available metrics or functionality
• Third-party outages
• Data delays or inaccuracies originating from third-party providers
• Suspension or termination of access by a third-party provider
• Changes to third-party terms or policies

5. Google Postmaster Tools

RepMonitor may integrate with Google Postmaster Tools using Google OAuth.

Use of this integration requires the user to authorize RepMonitor through Google's authorization process.

RepMonitor will access Google Postmaster Tools data only within the scope authorized by the user and in accordance with our Privacy Policy and applicable Google API policies.

Google may change, restrict, discontinue, or modify the Google Postmaster Tools API or the data available through it at any time.

RepMonitor does not guarantee that any particular Google Postmaster metric, report, historical data point, compliance indicator, or other data will remain available.

6. Acceptable Use

You agree not to use RepMonitor:

• For any unlawful purpose
• To access data, accounts, domains, or systems without authorization
• To interfere with or disrupt RepMonitor's infrastructure
• To bypass authentication, security controls, rate limits, or technical restrictions
• To reverse engineer or attempt to obtain unauthorized access to RepMonitor systems, except where such restrictions are prohibited by applicable law
• To introduce malware, malicious code, or harmful automated activity
• To scrape, copy, reproduce, or systematically extract RepMonitor data or functionality in a way that materially interferes with the service
• To impersonate another person or organization
• To use RepMonitor in a manner that violates the terms or policies of connected third-party services

We may suspend or restrict access where we reasonably believe use of the service creates a security, legal, operational, or abuse risk.

7. Email Deliverability Disclaimer

RepMonitor is a monitoring and reporting tool.

Email deliverability is affected by many factors outside RepMonitor's control, including:

• Sender reputation
• Domain configuration
• Authentication
• Message content
• Recipient engagement
• Spam complaints
• Sending patterns
• Mailbox provider policies
• Email service provider infrastructure
• Blacklists and reputation systems
• Recipient behavior
• Changes made by third-party platforms

RepMonitor does not guarantee:

• Inbox placement
• Delivery to any particular mailbox provider
• Specific open, click, reply, or conversion rates
• Removal from blocklists
• Improvement of sender or domain reputation
• Continued availability of any particular metric
• Compliance with any mailbox provider's requirements

Information shown in RepMonitor should be considered operational monitoring information and not a guarantee of future email performance.

8. Data Accuracy

RepMonitor relies in part on information received from third-party systems.

We aim to display and process this information accurately, but we do not warrant that all information will be complete, current, error-free, or available at all times.

Data may be delayed, incomplete, unavailable, recalculated, or modified by the original provider.

Users should verify critical information directly with the relevant provider where necessary.

9. No Professional or Legal Advice

RepMonitor provides technical monitoring and informational tools.

Information provided through RepMonitor does not constitute legal, regulatory, compliance, financial, or professional advice.

Users remain responsible for determining whether their email practices comply with applicable:

• Laws and regulations
• Contractual obligations
• Privacy requirements
• Anti-spam requirements
• Mailbox provider rules
• Email service provider policies

Where necessary, users should obtain advice from qualified professionals.

10. Intellectual Property

RepMonitor, including its software, interface, design, branding, documentation, original content, and underlying technology, is owned by or licensed to Mad Lead Printer and is protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not reproduce, distribute, modify, sell, license, or create derivative works from RepMonitor without our permission.

These Terms do not transfer ownership of RepMonitor or its intellectual property to users.

Third-party names, trademarks, and services referenced by RepMonitor remain the property of their respective owners.

11. User and Connected Data

You retain any rights you have in data that you provide to or connect with RepMonitor.

You grant RepMonitor the limited rights necessary to access, process, store, organize, synchronize, and display that data for the purpose of operating and providing the service.

Our collection, use, storage, and deletion of personal information and Google user data is described in our Privacy Policy.

12. Service Availability

We aim to maintain reliable access to RepMonitor but do not guarantee continuous, uninterrupted, or error-free availability.

The service may occasionally be unavailable because of:

• Maintenance
• Software updates
• Infrastructure issues
• Security incidents
• Third-party service outages
• Internet or hosting failures
• Events beyond our reasonable control

We may modify, suspend, remove, or discontinue features where reasonably necessary for technical, operational, security, legal, or business reasons.

13. Beta and Developing Features

RepMonitor may include features that are new, experimental, under development, or provided on a beta basis.

Such features may:

• Change without notice
• Contain errors
• Produce incomplete results
• Be temporarily unavailable
• Be removed or replaced

Users should not rely on experimental or beta functionality for critical operations without independently verifying the relevant information.

14. Security

We use reasonable technical and organizational measures intended to protect RepMonitor and information processed through the service.

However, no software, network, transmission method, or storage system can be guaranteed to be completely secure.

You are responsible for maintaining appropriate security practices for your own accounts, credentials, devices, and connected platforms.

15. Suspension and Termination

You may stop using RepMonitor at any time.

We may suspend, restrict, or terminate access to RepMonitor where reasonably necessary, including where:

• These Terms are materially violated
• Unauthorized access is suspected
• Use of the service presents a security risk
• Use may violate applicable law
• Use may cause harm to RepMonitor, third-party providers, or other users
• Continued access is no longer technically or commercially feasible

Where reasonably practical, we may provide notice before termination, but immediate action may be taken where necessary to protect security or comply with legal obligations.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, RepMonitor is provided on an "as is" and "as available" basis.

We make no warranty that:

• RepMonitor will always be available
• The service will be completely error-free
• Third-party data will always be accurate or available
• RepMonitor will meet every user's specific requirements
• Any particular email deliverability outcome will be achieved

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Mad Lead Printer and its owner, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the use of RepMonitor.

This includes, without limitation, loss of:

• Revenue
• Profit
• Business opportunities
• Data
• Email deliverability
• Reputation
• Customers
• Expected savings

We will not be responsible for losses caused by actions, outages, data, or policy changes of third-party services.

To the extent liability cannot legally be excluded, our liability will be limited to the maximum extent permitted by applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Mad Lead Printer from claims, losses, liabilities, damages, and reasonable costs arising from:

• Your unlawful use of RepMonitor
• Your violation of these Terms
• Your unauthorized connection of third-party accounts or data
• Your violation of third-party rights
• Your use of RepMonitor in violation of a third-party platform's terms or policies

19. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

• RepMonitor functionality
• Connected integrations
• Legal requirements
• Security practices
• Business operations

The effective date at the top of this page will be updated when the Terms change.

Continued use of RepMonitor after updated Terms take effect constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

20. Governing Law

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, disputes relating to these Terms or RepMonitor will be subject to the jurisdiction of the competent courts in Novi Sad, Serbia.

21. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

22. Entire Agreement

These Terms, together with the Privacy Policy and any other terms expressly incorporated by reference, constitute the agreement between the user and Mad Lead Printer regarding use of RepMonitor.
